NEW NORTH CAROLINA TRAILERING REGULATIONS

The North Carolina General Assembly voted to override Governor Easley's veto of House Bill 2167 that has changed the boat trailering laws in North Carolina.

House Bill 2167 became law and went into effect at 11:39 a.m. August 27, 2008

The effect of this new law is as follows:

1.) Any boat or boat trailer with an outside width of less than 120 inches may be towed without a permit.
2.) Any boat or boat trailer with an outside width of less than 114 inches may be towed on any road, on any day of the week, including weekends and holidays and may travel at night.
3.) Any boat or boat trailer with an outside width of 114 to 120 inches may be towed on any day of the week, including weekends and holidays from sun up to sun down.
4.) A boat or boat trailer with an outside width in excess of 102 inches but less than 120 inches must be equipped with a minimum of two operable amber lights on the widest point of the boat or boat trailer such that the dimensions of the boat or boat trailer are clearly marked and visible. (amber lights are not required to be DOT approved.) - An easy way to meet this requirement is to put the amber lights on the outside of your trailer guide-ons.
5.) Boats or boat trailers with a width of 120 inches or more must have a permit issued and may travel seven days a week and on holidays only during daylight hours. (Sun up to Sun Down). Annual Permits are $100 and can be obtained by calling 888-221-8166. Normal hours of operation are 7:30 am until 4 pm, Monday thru Friday.

The following requirements have not changed.
1.) All trailers must have working tail lights and an up to date license plate.
2.) Towing vehicle must have the appropriate weighted tags to cover the weight of the boat, trailer and towing vehicle. SUV's are exempt from this requirement.
3.) Any boat and trailer that has a combined weight of over 4000 lbs. must have a state inspection sticker. Boat trailer inspections can only be done at a facility that issues tags for motorcycles. 4.) Boats over 102" must be equipped with four (4) red flags, one on each corner of the widest point of the boat or boat trailer. In addition boats 120" or wider are required to have Wide Load signs on the front of the tow vehicle and on the rear of the load being towed.
5.) A North Carolina Class A Drivers License is still a requirement to tow any trailer with a gross vehicle weight of 10,001 pounds or greater. Information on obtaining this license is available at all N.C. drivers' license facilities.

HOUSE BILL 2167

AN ACT TO INCREASE THE WIDTH OF BOATS THAT MAY BE TRANSPORTED ON HIGHWAY ROUTES DURING THE DAY AND NIGHT WITHOUT A PERMIT AND TO PROVIDE FOR AN ANNUAL PERMIT AS OPPOSED TO A SINGLE TRIP PERMIT FOR OVERSIZE BOATS.

The General Assembly of North Carolina enacts:

SECTION 1.G.S. 20-116 is amended by adding a new subsection to read:
"20-116. Size of vehicles and loads.

...
(m) Notwithstanding subsection (a) of this section, a boat or boat trailer with an outside width of less than 120 inches may be towed without a permit. The towing of a boat or boat trailer 102 inches to 114 inches in width may take place on any day of the week, including weekends and holidays, and may take place at night. The towing of a boat or boat trailer 114 inches to 120 inches in width may take place on any day of the week, including weekends and holidays from sun up to sun down. A boat or boat trailer in excess of 102 inches but less than 120 inches must be equipped with a minimum of two operable amber lamps on the widest point of the boat and the boat trailer such that the dimensions of the boat and the boat trailer are clearly marked and visible."

SECTION 2. G.S. 20-119(g) reads as rewritten:
"20-119. Special permits for vehicles of excessive size or weight; fees.

...
(g) The Department of Transportation shall issue annual overwidth permits for the following: vehicles
(1) A vehicle carrying agricultural equipment or machinery from the dealer to the farm or from the farm to the dealer that do does not exceed 14 feet in width. These permits shall be A permit issued under this subdivision is valid for unlimited movement without escorts on all State highways where the overwidth vehicles do vehicle does not exceed posted bridge and load limits.
(2) A boat or boat trailer whose outside width equals or exceeds 120 inches. A permit issued under this subdivision must restrict a vehicle's towing of the boat or boat trailer to daylight hours only.
"

SECTION 3. This act is effective when it becomes law.
In the General Assembly read three times and ratified this the 17th day of July, 2008.

Became law notwithstanding the objections of the Governor, 11:39 a.m. this 27th day of August, 2008.
